MUZAFFARABAD (Kashmir English): The AJK High Court on Friday removed the chairmanship of Shaukat Nawaz Mir from the Central Traders Association Muzaffarabad, refraining from calling Mir chairman.
While announcing the verdict of the petition, the high court also ordered the government to implement the Trade Organizations Registration and Regulation Act, 2019, within 90 days. The petition was filed by Syed Tayyab Ali Shah.
Justice Chaudhry Khalid Rasheed heard the case and ordered the immediate removal of several other traders’ association officials from their posts.
Presiding over the case, Justice Chaudhry Khalid declared that the officials, including Shaukat Nawaz Mir, are no longer authorised to act in their previous capacities and must refrain from calling themselves chairmen.
This ruling forms part of the court’s more general decision to enforce the Trade Organizations Registration and Regulation Act, 2019, within 90 days.
The petition was filed by Syed Tayyab Ali Shah and represented in court by advocates Syed Shujaat Naqvi and, initially, Fayyaz Hassan Mughal.
Syed Abdul Samad Advocate and Raja Waqar Ali Khan Advocate appeared for the respondents and Advocate Farkhanda Abrar made an appearance on behalf of the government departments involved.
According to the judgment, the AJK government will follow the Trade Organizations Registration and Regulation Act, 2019, and control the registration, functioning, and monitoring of trade bodies in the area.
Trade organisations are required to register formally and their actions are monitored by a common set of laws under this act. The new legislation also requires that new elections for trade representatives take place.
The main goals of the Trade Organizations Registration and Regulation Act, 2019, are to regulate trade groups and guarantee operational transparency.
It specifically addresses the registration, management, and control of different trade associations, federations, chambers of commerce and industry, and others.
The judgment demonstrates how the judiciary helps keep the rule of law, and it also stresses the value of the Trade Organizations Registration and Regulation Act, 20,19 in maintaining clear and open rules in conducting trade.
