Mirpur housing schemes asked not to allot plots to non-state subject persons

MIRPUR (Kashmir English): Mirpur Division Commissioner Chaudhry Mukhtar Hussain has directed the concerned to ensure that no private housing society allots plot to non-state subject persons.

He directed the concerned district administrations to register private housing schemes as per the law and rules adding the No-Objection Certificate (NOC) should not be issued to these housing societies without town planning.

The directions came as the Commissioner took notice of public complaints over reported mushroom growth of private housing schemes in Mirpur Division.

While chairing a high-level meeting, attended by the Deputy Commissioners of all the three districts of Mirpur, Kotli and Bhimber, besides other related senior officers of the districts and divisional administrations, the Commissioner directed the Deputy Commissioners that no plots should be allotted to any non-state subject person in the housing societies nor the non-state subject persons should be allowed to buy, sell and transfer plots under the prevailing state-subject laws.

Publicity campaign of private housing schemes

The Commissioner further directed that In the publicity campaign of the private housing societies, it should be clearly written that “non-state subject persons are not eligible to buy and sell plots”.

In this regard, Commissioner Mirpur Division Chaudhry Mukhtar Hussain also instructed the Deputy Commissioners of Mirpur, Kotli and Bhimber to fulfill all legal and constitutional requirements regarding the registration of private housing schemes in their respective districts.

According to the Commissioner, it had been observed that private housing schemes were being established very rapidly in Mirpur Division.

He said it was the primary responsibility of the State functionaries appointed by the government to ensure the protection of the rights of the people of the state.

He directed that as the head of the district administration, the Deputy Commissioners, among other duties, within the limits of their respective districts, should take timely regulatory measures regarding newly established housing schemes so that the investment made by the local residents in private housing schemes should not go unsafe and the people making such investments do not face any problems in the future.

Commissioner Mirpur Division Chaudhry Mukhtar Hussain strictly advised that instructions issued in this regard should be implemented in letter and spirit.

“It should be ensured that the private housing scheme construction company is registered as per the law, before execution of the construction works in the schemes.

No housing scheme will be allowed to operate without having town planning, he categorically ordered the respective district administrations.

“In terms of Section 4 of the Jammu and Kashmir Transfer of Property Act, 1995 (BKRM), no plot in the private housing schemes to be established within the limits of Azad Jammu and Kashmir, will be allowed to be allotted, sold or transferred to any non-state subject person. Nor any non-state subject person be offered to purchase plots of such schemes”, the Commissioner advised.

He declared that it will be mandatory for the owners, managements of such private housing schemes to prominently write on the publicity hoardings, advertisements to be published in connection with their advertising campaign, that non-state subject residents will not be eligible to purchase plots in such private housing schemes being established in the AJK territory.

The Commissioner further directed that it will be mandatory for every housing scheme to allocate space for a mosque in proportion to the residential plots.

“It will also be mandatory for every housing scheme to provide space for a graveyard, keeping in mind the future needs.”
