AJK Supreme Court restores membership of MLA Sardar Mir Akbar

MUZAFFARABAD (Kashmir English): The Supreme Court of Azad Jammu and Kashmir (AJK) has declared the decision of the Election Tribunal regarding the annulment of the elections of MLA Sardar Mir Akbar Khan null and void.

A full court comprising the Chief Justice Raja Saeed Akram Khan, Senior Judge Justice Raza Ali Khan and Justice Chaudhry Khalid Yousaf has given a verdict in the case of Sardar Mir Akbar Khan vs. Sardar Qamar Zaman.

On July 22, 2025, the Election Tribunal declared the elections to constituency LA-15 (Sharqi Bagh), held in July 2021, null and void due to alleged rigging and administrative irregularities.

Later, Sardar Mir Akbar had lodged a petition in the Supreme Court, challenging the Tribunal’s verdict.

Announcing the verdict today, the court has accepted the appeal of Mir Akbar and dismissed the appeal of Sardar Qamar Zaman Khan, after which the former will continue to remain a member of the Legislative Assembly.

The Election Tribunal of Azad Kashmir had earlier declared the victory of Sardar Mir Akbar Khan null and void, which he had challenged in the Supreme Court.

The Supreme Court had issued a stay order in the initial hearing, suspending the decision of the tribunal.

During the hearing that lasted for two days, the lawyers of the parties presented their arguments, after which the court ordered to maintain the membership of Mir Akbar Khan.

Mir Akbar was represented by Abdul Rashid Abbasi and Raja Gul Majeed Khan, while Sardar Qamar Zaman Khan was represented by Raja Sajjad Khan, Raja Shafaat Khan and Barrister Humayun Nawaz.

After the completion of the arguments, the court rejected the tribunal’s decision and issued a decision in favor of Mir Akbar.
